Standard Working Hours (Arbeidstijdenwet)
The Dutch Working Hours Act (Arbeidstijdenwet) sets general limits to protect employees' health and safety and promote a healthy work-life balance.
- Typical Full-Time Week: A standard full-time work week in the Netherlands is typically 36, 38, or 40 hours, often spread over five days. Many Collective Labour Agreements (CAOs) and company policies stipulate a 36 or 38-hour week.
- Maximum Hours Per Shift: You cannot work more than 12 hours per shift.
- Maximum Hours Per Week: You cannot work more than 60 hours per week. However, this is usually an absolute maximum in exceptional circumstances. Over a 4-week period, you generally shouldn't exceed 55 hours per week, and over a 16-week period, the average must not exceed 48 hours per week.
- Rest Periods: Employees are entitled to regular rest periods. After 5.5 hours of work, a minimum 30-minute break is required. After a shift, a minimum of 11 consecutive hours of rest must be taken (with some exceptions).
Cultural Norm:
While longer hours are legally possible, in practice, a good work-life balance is highly valued in Dutch culture. Finishing on time is usually the norm, not an exception.
Overtime Regulations (Overwerk)
The concept of "overtime" can vary, and its compensation is often governed by employment contracts or Collective Labour Agreements (CAOs).
- No Statutory Overtime Pay: Dutch law does not explicitly mandate extra pay for overtime. The Working Hours Act primarily sets limits on hours worked, not how they are compensated.
- Contractual Agreements: Your employment contract or the
applicable CAO will typically define what constitutes overtime and how
it is compensated. Common arrangements include:
- Time for Time (tijd voor tijd): You receive extra time off instead of extra pay for working overtime.
- Overtime Surcharge: A percentage on top of your regular hourly wage (e.g., 125% or 150%), especially for evenings, weekends, or public holidays.
- Included in Salary: For higher-paid positions, it's sometimes stipulated that overtime is already included in your fixed salary and not separately compensated.
- Management Responsibility: Employers are responsible for ensuring employees do not work more than the legal maximums, even if they volunteer for extra hours.
